Yes he is (or at least was). We bought the X-men and the SHIELD car set at the Sherway LEGO store in Toronto to get to $50 and received him!

The SDCC is fantastic! I wasn't going to open them up to play with but the kids decided otherwise. Captain America is still sealed up as we already had two but the other three are at large and well...
