Just saw the packaging for the new McFarlane (weapons) accessory pack and in the top corner it clearly says “not a toy”. Is there a reason for that ?

100% WB rules. There are no laws for tiny scale toy guns that are obvious toys.
Laws kick in at realistic scales.
McFarlane has to follow the licensing rules to make the toys but as its own company they are 100% allowed to make their own products which includes "not a toy" gun collectibles. Labelling it as "not a toy" is just to appease WB licensing agreements. Make silly rules and you end up with silly results.
Not just guns either. One of the first victims of this rule was a Mezco Constantine that was missing guns and a cig while having hands sculpted to obviously hold guns and a cig.
