We can't assume that for 2 reasons:
Likeness license is case by case. Marvel Legends could get Tom Holland but not Andrew Garfield.
Joker's likeness may be easier to skirt around due to the...

The lack of likeness is due to a lack of licensing on the side of McFarlane. And yeah, Scarecrow aint great because they went for the look he only has for less than a minute. Would have been better...
